1. ACCEPTANCE OF TERMS
Welcome to NestLift Construction LLC ("NestLift," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website at nestlift.homes (the "Site") and the construction and home improvement services we provide (the "Services").
By using our Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or Services after changes are posted constitutes acceptance of the modified Terms.
2. DESCRIPTION OF SERVICES
NestLift provides pre-sale home improvement, renovation, and construction services primarily for residential properties in the Chicago, Illinois metropolitan area, including Cook County and DuPage County.
Our Services include, but are not limited to:
Pre-sale property transformations
Home inspection repairs
Rental property turnarounds
Move-in ready customizations
Room renovations (bathrooms, kitchens, bedrooms, living rooms, dining rooms, mudrooms, garages)
Services are provided in three quality tiers: Essential, Refined, and Luxury.
3. ELIGIBILITY
3.1 Age Requirement
You must be at least 18 years old and legally competent to enter into contracts to use our Services.
3.2 Property Ownership or Authorization
You must be the property owner or have legal authorization from the property owner to request Services at a given property. You represent and warrant that you have all necessary rights and permissions to contract for Services at the specified property.
3.3 Service Area
Our Services are currently available only in the Chicago, Illinois metropolitan area. We reserve the right to decline service requests outside our coverage area or beyond our current capacity.
4. QUOTES AND PRICING
4.1 Pricing Calculator
Our online pricing calculator provides estimated costs based on square footage, room type, and quality tier selections. These are estimates only and are not binding quotes.
4.2 Final Quotes
All quotes are subject to verification through an in-person consultation and property inspection. Final pricing will be provided in writing and may differ from calculator estimates based on:
Actual property conditions
Code compliance requirements
Unforeseen structural or system issues
Material availability and costs
Customer changes or additions to scope
4.3 Quote Validity
Written quotes are valid for 30 days from the date of issue unless otherwise specified. Material costs, labor rates, and availability may change after this period.
4.4 What's Included
Unless otherwise specified in your written quote, pricing includes:
Materials as specified in your quality tier
Labor for installation and construction
Permits and inspections (where required)
Project management and coordination
Cleanup and debris removal
Standard warranty (Section 10)
4.5 What's Not Included
The following are typically NOT included unless explicitly stated in your quote:
Repairs to hidden damage discovered during demolition
Code violations existing prior to our work
Structural repairs beyond scope of work
Asbestos or lead abatement
Mold remediation beyond surface cleaning
Furniture moving or storage
Temporary housing during construction
Landscaping restoration
Any work outside the specified project scope
5. PAYMENT TERMS
5.1 Payment Schedule
Unless otherwise agreed in writing, payment terms are typically:
Deposit: 50% of total project cost due upon contract signing
Progress Payment: 40% due at substantial completion
Final Payment: 10% due upon final completion and customer acceptance
Alternative payment schedules may be arranged for larger projects.
5.2 Payment Methods
We accept payment by:
Check
Credit/debit card (processing fees may apply)
ACH/bank transfer
Financing through approved partners (Acorn Finance)
5.3 Late Payments
Payments not received within 10 days of the due date are subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by Illinois law, whichever is less. We reserve the right to suspend work on projects with overdue payments.
5.4 Liens
In accordance with Illinois law, we reserve the right to file a mechanic's lien against the property for unpaid amounts. You agree to pay all costs and attorney's fees associated with collection efforts.
6. FINANCING
6.1 Third-Party Financing Disclosure
We partner with Acorn Finance and other financing providers to offer payment options. Financing is subject to credit approval by the financing provider, not NestLift.
Home improvement financing is offered through Acorn Finance and provided by Acorn Finance's network of participating third-party lenders. NestLift Construction LLC is not a lender, loan broker, or agent for any lender or loan broker, and does not make credit decisions or guarantee loan approval, interest rates, or specific loan terms.
All financing is subject to credit approval. Interest rates, loan terms, and monthly payment amounts vary based on your creditworthiness, loan amount, loan term, and credit usage and history, and will be agreed upon between you and the lender. Pre-qualification inquiries result in a soft credit pull which will not affect your credit score. Submitting an actual loan application may result in a hard credit inquiry which may impact your credit score.
6.2 Financing Terms
Financing terms, rates, and approval are determined solely by the financing provider
NestLift is not responsible for financing denials or changes to financing terms
You are responsible for understanding all financing terms before accepting
6.3 No Financial Advice
We do not provide financial advice. Financing information provided is for informational purposes only. Consult with a financial advisor regarding financing decisions.
7. PROJECT TIMELINE AND SCHEDULING
7.1 Timeline Estimates
Project timelines provided are estimates based on typical conditions. Actual completion times may vary due to:
Weather conditions
Material delivery delays
Permit or inspection delays
Discovery of unforeseen conditions
Changes to project scope
Force majeure events (Section 15)
7.2 Start Dates
Project start dates are scheduled based on our availability and will be confirmed in writing. We will make reasonable efforts to meet scheduled start dates but cannot guarantee specific dates.
7.3 Access Requirements
You must provide NestLift and our contractors with reasonable access to the property during normal business hours (Monday-Friday, 7 AM - 5 PM, unless otherwise agreed). Failure to provide access may result in project delays and additional costs.
7.4 Delays Beyond Our Control
NestLift is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to weather, material shortages, labor disputes, or governmental actions.
8. CHANGE ORDERS AND MODIFICATIONS
8.1 Scope Changes
Any changes to the agreed-upon scope of work must be documented in a written change order signed by both parties. Verbal agreements or changes are not binding.
8.2 Pricing Changes
Changes to project scope may result in adjustments to the total price and timeline. We will provide pricing for change orders before proceeding with additional work.
8.3 Customer-Requested Delays
If you request that work be delayed or suspended, you may be charged:
Storage fees for materials already purchased
Rescheduling fees to restart work
Additional costs due to material price increases during the delay
9. PERMITS AND CODE COMPLIANCE
9.1 Permit Responsibility
Where required by law, NestLift will obtain necessary building permits. You are responsible for ensuring that any required permits not obtained by NestLift are secured before work begins.
9.2 Code Compliance
All work will be performed in accordance with applicable building codes and regulations in effect at the time of construction. We are not responsible for bringing pre-existing conditions up to current code unless specifically included in the scope of work.
9.3 Inspections
Required inspections will be scheduled and coordinated by NestLift. You must provide access for inspectors and address any inspection failures or required corrections as directed.
9.4 HOA/Condo Approval
If your property is subject to homeowners association (HOA) or condominium association rules, you are responsible for obtaining any required approvals before work begins. We are not responsible for violations of HOA rules or delays caused by HOA approval processes.
10. WARRANTIES
10.1 Workmanship Warranty
NestLift warrants that all work will be performed in a professional and workmanlike manner and will be free from defects in workmanship for a period of one (1) year from the date of project completion.
10.2 Material Warranties
Materials are covered by manufacturer warranties, which vary by product. We will provide documentation of manufacturer warranties where applicable.
10.3 Warranty Exclusions
Our workmanship warranty does not cover:
Normal wear and tear
Damage caused by misuse, neglect, or lack of maintenance
Damage caused by third parties
Alterations or repairs made by others
Damage from acts of God, weather events, or disasters
Pre-existing conditions not addressed in our scope of work
Failure to follow care and maintenance instructions
10.4 Warranty Claims
To make a warranty claim, you must provide written notice within the warranty period. We will have reasonable opportunity to inspect and repair any defects. Our obligation is limited to repair or replacement of defective work.
10.5 Limitation of Liability
This warranty is in lieu of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Our total liability under this warranty shall not exceed the amount paid for the Services.
11. CUSTOMER RESPONSIBILITIES
You agree to:
11.1 Property Preparation
Remove or protect personal property in work areas
Ensure utilities (water, electricity, gas) are available and functioning
Disclose known hazards, issues, or special conditions
Secure pets during work hours
11.2 Decision-Making
Make timely selections of materials, colors, and finishes
Respond promptly to questions or requests for decisions
Be available for consultations as reasonably needed
11.3 Payment
Make all payments according to the agreed schedule
Provide accurate billing and contact information
11.4 Communication
Provide a single point of contact for project communications
Communicate concerns or issues promptly
12. CANCELLATION AND REFUNDS
12.1 Customer Cancellation - Before Work Begins
You may cancel your contract before work begins with written notice. If you cancel:
Within 3 business days of signing (Illinois "cooling off" period): Full refund minus any non-refundable deposits for custom-ordered materials
After 3 business days but before work begins: Deposit is forfeited, minus any costs incurred for materials, permits, or design work
12.2 Customer Cancellation - After Work Begins
If you cancel after work has begun:
You are responsible for payment for all work completed
You are responsible for all materials purchased
Any remaining deposit may be applied to outstanding balances
12.3 NestLift Cancellation
We reserve the right to cancel a contract if:
You fail to make required payments
You fail to provide necessary access to the property
Unforeseen conditions make the project unsafe or impractical
You breach these Terms
In such cases, you will be charged for work completed and materials purchased.
12.4 Refund Processing
Approved refunds will be processed within 30 days of cancellation.
13. LIABILITY AND INDEMNIFICATION
13.1 Limitation of Liability
To the maximum extent permitted by law:
NestLift's total liability for any claims arising out of or related to the Services shall not exceed the total amount paid by you for the Services that are the subject of the claim.
We are not liable for:
Indirect, incidental, consequential, or punitive damages
Lost profits or business interruption
Property damage not directly caused by our negligence
Damage to items you failed to remove or protect
Delays or failures due to circumstances beyond our control
13.2 Property Damage
We maintain general liability insurance. Claims for property damage must be reported immediately and in writing. We will work with our insurance carrier to address valid claims.
13.3 Indemnification
You agree to indemnify and hold harmless NestLift, its officers, employees, and contractors from any claims, damages, or liabilities arising from:
Your failure to disclose property conditions or hazards
Your failure to obtain necessary permissions or approvals
Your breach of these Terms
Injuries or damages caused by your actions or negligence
14. INTELLECTUAL PROPERTY
14.1 Our Content
All content on our Site, including text, graphics, logos, designs, and software, is owned by NestLift or our licensors and is protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.
14.2 Project Documentation
Designs, plans, specifications, and other project documents prepared by NestLift remain our property unless otherwise agreed in writing. You receive a limited license to use these documents for the specific project.
14.3 Before/After Photos
We may request permission to photograph your project for marketing purposes. You have the right to decline. If you consent, we may use project photos on our website, social media, and marketing materials.
15. FORCE MAJEURE
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including:
Natural disasters (earthquakes, floods, severe weather)
Pandemics or public health emergencies
Acts of war or terrorism
Government orders or regulations
Labor disputes or strikes
Material or labor shortages
Utility failures
In such events, we will make reasonable efforts to resume performance as soon as practicable.
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before initiating formal legal action, both parties agree to make good-faith efforts to resolve disputes through informal negotiation.
16.2 Mediation
If informal negotiation fails, disputes shall be submitted to mediation in Cook County, Illinois before pursuing litigation. Both parties will share mediation costs equally.
16.3 Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
16.4 Jurisdiction and Venue
Any legal action arising from these Terms or the Services shall be brought exclusively in the state or federal courts located in Cook County, Illinois. Both parties consent to personal jurisdiction in these courts.
16.5 Attorney's Fees
In any legal action, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.
17. INSURANCE AND LICENSING
17.1 Our Insurance
NestLift maintains:
General liability insurance
Workers' compensation insurance (as required by Illinois law)

These Terms, together with any written contract for Services, constitute the entire agreement between you and NestLift and supersede all prior agreements, representations, and understandings.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3 Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
18.4 Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations to any party in connection with a business transfer.
18.5 Notices
All notices must be in writing and sent to:
